Making arrangements for your children after a relationship breakdown can be difficult and emotional.  There are a number of things to consider, such as where the children will live, who they will spend time with, and how to financially support them.  There is no one-size-fits-all solution, and what works for one family may not work for another.  It’s important to try to come to an agreement that is in the best interests of the children, and to put their well-being and developmental needs first.

Child Arrangements will not always require court intervention; when the parties involved still maintain an amicable relationship, or, where third-party intervention can assist in producing an agreement, private resolution can ensure the family dynamic remains a positive influence for the children concerned. BH Support can assist in conducting private negotiations to reach an agreement between both parties; once an agreement is reached, a formal document can be made and presented to the Court in the form of a Consent Order to provide the agreed terms with the same legal enforceability as if this was decided within court.

Parents and guardians are encouraged to try mediation before proceeding to Court. If the court route is more suitable for their particular situation, and mediation is therefore inappropriate or unsuccessful, you may apply to the courts to have a judge assess your situation and split contact accordingly. It is worth noting that the Court process can be complex and emotionally fuelled; it is important to seek advice and support throughout. This can help ensure all applications are correct, deadlines are met, and any children involved are protected. BH Support can provide assistance every step of the way throughout the court process for those who do require the courts’ involvement.

Within the family support provision, our team supports many local families through the family courts as court trends change and legal aid is reduced further and rarely available.
